1. General Usage Policy

By hiring a vehicle from Daeton Ventures, the Hirer declares and agrees that:

  • The motor vehicle will be used strictly for the agreed-upon purpose.
  • The Hirer is between the ages of 23 and 70 years old.
  • The Hirer does not suffer from any physical infirmity or defective hearing that is likely to affect their driving ability.
  • The Hirer has not been convicted during the last five years of any offense for careless, reckless, or dangerous driving.
  • The Hirer holds a driving license that has been valid for at least two years, is current, and is free from any endorsements.
  • In connection with motor insurance, no insurer has at any time declined the Hirer's proposal, imposed special conditions, refused to renew their policy, or cancelled their policy.
  • The motor vehicle will not be used for the carriage of passengers for hire or reward.
  • The motor vehicle will not be used to carry more than the authorized passenger capacity.
  • The motor vehicle will only be driven by the authorized persons who have been explicitly declared during the booking and hiring process.

Note: Any extension of the hire period beyond two hours without prior written consent will be charged as a full day.

The Hirer fully understands that they are the sole authorized person to drive this vehicle unless other drivers are explicitly specified in the agreement. The vehicle is hired for the specified period, and if that period is exceeded unlawfully, the vehicle may be considered stolen and the matter reported to the police.

NB: The vehicle is not authorized to transport prohibited goods or be used as a taxi. The vehicle must not be used to aid any criminal activities as prescribed under the laws of Kenya. If found in violation, the Hirer will be personally liable. The Hirer indemnifies and shall keep Daeton Ventures indemnified against any criminal or civil liability that may occur as a result of any misuse of the vehicle or actions of the Hirer.

2. Terms of Agreement

  1. Daeton Ventures hereby agrees to let the vehicle on self-drive hire to the Hirer, and the Hirer hereby agrees to hire the motor vehicle subject to the terms and conditions set out herein.
  2. The period of hire shall be as set out in the booking agreement. The vehicle must be returned to Daeton Ventures on the date and time stipulated. Unless the overall period is extended by notifying Daeton Ventures in writing ahead of time, Daeton Ventures will charge the Hirer an hourly fee of KES 1,000 for every extra hour incurred beyond the return time.
  3. In accepting the vehicle, the Hirer shall be deemed to have satisfied themselves that the vehicle is roadworthy, safe, and in proper working order. Daeton Ventures shall not be liable to make any payments or offer compensation to the Hirer in the event of a breakdown.
  4. The hire charges shall be based on the number of days the vehicle is hired. If the vehicle's speedometer seal has been tampered with, the charges shall be set at a penalty rate of KES 50,000, and the Hirer shall be fully responsible for its replacement.
  5. The Hirer further agrees that:
    • The Hirer will not drive (and will ensure that no unauthorized driver shall drive) the vehicle whilst under the influence of alcohol, narcotics, barbiturates, or any other substances impairing the driver's consciousness or ability to control the vehicle.
    • All traffic laws, rules, and provisions of the Highway Code shall be observed at all times.
    • The vehicle will be kept locked and secured when parked, and every precaution will be taken to avoid theft or damage.
    • The vehicle shall be used for social and pleasure purposes only, and restricted to all-weather roads. The vehicle shall not be used for racing or pace-making.
    • The vehicle shall not be taken outside the borders of Kenya.
    • The Hirer shall promptly and timely pay any parking and traffic fines. Failure to do so will result in an additional administrative fee of KES 1,000 per fine, alongside indemnifying Daeton Ventures against any loss.
    • The Hirer shall routinely check the engine oil, water coolant, and tire pressure. Failure to perform these routine checks makes the Hirer responsible for reimbursing Daeton Ventures for resulting damages.
    • Unless explicitly authorized by Daeton Ventures in writing, the Hirer shall under no circumstances modify or attempt to repair the vehicle.
  6. In the event of a breakdown, accident, or damage resulting from the willful act or gross neglect of the Hirer, the Hirer shall pay Daeton Ventures the total cost of towing the car and the full repair or replacement value of the vehicle.
    • The Hirer is responsible for paying for the repair of punctures, replacing burst tires, stolen or lost spare tires, damaged or broken windscreens, and missing tools (including the jack).
    • In the case of an accident, the Hirer must report it to the police and Daeton Ventures within 24 hours, regardless of the extent of the damage. The Hirer must supply Daeton Ventures with the police abstract and officer details.
    • If any anti-theft device installed in the vehicle is not utilized by the Hirer and the vehicle is stolen, the Hirer will be liable to pay the core costs of the vehicle.
  7. Damage to the vehicle, loss by fire or theft, material damage to any other vehicle or property, and injury to the driver or passengers are not automatically covered by standard waivers. In the case of a third-party injury claim, the Hirer shall be responsible for bearing the claim and excess premium.

    The insurance and collision damage waiver options do not cover:

    • Any loss of personal items from the vehicle.
    • Any internal breakdown or damage to the vehicle otherwise than by collision.
    • Burst tires, lost spare wheels, damaged windscreens or glasses, and damaged rims or tools.
  8. All vehicles are comprehensively insured. However, all first excess premiums on every claim are the strict responsibility of the Hirer.

    Important:

    Insurance covers are only valid if the terms and conditions contained herein and in the official insurance policy are complied with. Failing this, the Hirer shall be fully responsible for all damages and costs.

  9. Payment Terms: In addition to the deposit, the full identification and physical address of the Hirer must be provided. Where required by Daeton Ventures, an acceptable guarantee shall be provided.

By using Daeton Ventures' services and hiring a vehicle, you hereby agree to all the professional terms and conditions enclosed in this contract and accept full responsibility for the vehicle until it is returned to Daeton Ventures.
